You may duplicate and/or arrange these images on your computer(s) for these purposes on your computer, and may alter the color of a given shape to suit specific design needs in an interior or exterior space, but are not authorized to modify the shape, look, curvature,  or other general \"feel\" of these images for any purpose without 3form's express consent.  In this License Agreement, the downloaded image(s), content, related documentation, and/or any copies or modifications are referred to as the \"Licensed Product.\"</p><p>Licensor holds title to each copy of the Licensed Product, each image of which is, or will be, the subject of one or more state or U.S. federal Copyright or Design Patent Applications, or other related common-law, U.S., or foreign intellectual property protection mechanisms.  </p><p>The Licensed Product shall only be downloaded on up to two computers in Licensee's control or possession at one time.  Any additional electronic copies for other computers not in Licensee's control or possession must be made by separate download by another party, who is a separate licensee subject to a separate license in accordance with these terms.  Licensee is only authorized to download these images for general interior or exterior architectural design use within the scope of a general company or organization license upon explicit permission granted by 3form directly in a separate licensing arrangement.</p><p>Licensee shall not transfer or distribute the Licensed Product to others, and this Agreement shall automatically terminate in the event of such a transfer or distribution.  Licensee shall not copy or modify the Licensed Product, except that Licensee may copy the Licensed Product for the sole purpose of backup, or may make electronic copies as needed on Licensee's computer(s) for designing an interior or exterior space, as long as all copyright and other notices are reproduced and included on the backup copy or design uses.  Licensee may also make hard-copy (non-electronic) printouts of designs incorporating the images of the Licensed Product as needed for general presentation purposes, promotional purposes, or other for some other publication, as long as all copyright and other notices are reproduced and included in a clear manner on the hard-copy.</p><p>All rights in this subject matter, such as the aforementioned, and all those not explicitly outlined in this agreement, are hereby expressly reserved by 3form.<p></blockquote><p><b>2.  Term</b></p><blockquote><p>This License Agreement is effective until terminated.  Licensee may terminate this License Agreement by \"returning\" the Licensed Product to Licensor.  For the purposes of this license, \"returning\" constitutes deleting the Licensed Product from all of Licensee's computers on which Licensee downloaded the image(s) associated with the Licensed Product.  Licensor may terminate this License Agreement if Licensee breaches any of the terms and conditions.  Upon termination of this License Agreement for any reason, Licensee shall delete any instance of the Licensed Product from any of Licensee's computers on which the image(s) of the Licensed Product was copied.  All provisions of this Agreement relating to disclaimers of warranties, limitation of liability, remedies, or damages, and Licensor's proprietary rights shall survive termination.</p></blockquote><p><b>3.  File Format</b></p><blockquote><p>The image(s) of the Licensed Product is/are delivered in an image file format (i.e., not on any type of electronic text file) only.  Licensee shall not reverse engineer the Licensed Product.</p></blockquote><p><b>4.  Limited Warranty</b></p><blockquote>Licensor does not warrant that the image(s) of the Licensed Product will meet Licensee's design requirements, or that the physical production or manifestation of the image(s) will be uninterrupted or error-free.  Licensor also does not warrant that the downloaded copy of the Licensed Product will be free from defects under normal use for a period of thirty (30) days from the date of delivery (\"Warranty Period\").  Licensee's exclusive remedy under this limited warranty is the replacement of any defective Licensed Product by additional download, or by requesting from 3form an optical disc containing the Licensed Product.</p><p>EXCEPT AS PROVIDED ABOVE, THE LICENSED PRODUCT IS PROVIDED \"AS IS\" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE LICENSED PRODUCT IS WITH LICENSEE.</p></blockquote><p><b>5.  Limitation of Liability</b></p><blockquote></p>LICENSOR'S SOLE OBLIGATION OR LIABILITY UNDER THIS AGREEMENT IS THE REPLACEMENT OF DEFECTIVE IMAGES ACCORDING TO THE LIMITED WARRANTY ABOVE.  IN NO EVENT WILL LICENSOR BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF DATA, OR LOSS OF PROFITS OR LOST SAVINGS, ARISING OUT OF USE OF OR INABILITY TO USE THE LICENSED PRODUCT OR DOCUMENTATION (OR ANY EVENTUAL PHYSICAL COPIES OR RELATED HARDWARE CREATED BASED ON THE LICENSED PRODUCT), EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.  IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY DAMAGES.</p></blockquote><p><b>6.  General</b></p><blockquote><p>Any hardware provided to Licensee by Licensor shall not be exported or re-exported in violation of any export provisions of the United States or any other applicable jurisdiction.  Any attempt to sublicense, assign or transfer any of the rights, duties or obligations hereunder is void.  This Agreement shall be governed by and interpreted under the laws of the State of Utah, United States of America, without regard to conflicts of provisions.  In the case of the United States Government or an agency thereof as Licensee, the following additional terms apply: Restricted Computer Licensed Product, as defined in the Rights in Data-General clause at Federal Acquisition Regulations 52.227-14; and as applicable,</p><blockquote><p><b>RESTRICTED RIGHTS LEGEND</b></p><p>Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Licensed Product clause at DFARS 252.227-7013.</p></blockquote><p>3form, Incorporated, Salt Lake City, Utah</p><p>LICENSEE ACKNOWLEDGES THAT IT HAS READ AND UNDERSTANDS THIS AGREEMENT AND AGREES TO BE BOUND BY ITS TERMS.
